Introduction

We hope you will enjoy your RYA course with Pembrokeshire Powerboating and Sailing Academy (PPSA).  Please read this section carefully as it contains important information.

  • 1.   Sailing and powerboating can be a physical activity and can involve some physically demanding requirements. Before booking, please satisfy yourself as to your suitability for the activity you are attending. If you are in any doubt, please contact PPSA.
  • 2.   PPSA will deliver the course to the standard required by the RYA.
  • 3.   Bookings will only be confirmed once the application forms (where requested) and deposit or full payment has been received. A 25% per person per course deposit must be paid when booking; with the balance paid at least 7 days before the commencement of the course. By paying the deposit and/or returning a completed booking form, clients accept our terms and condition as specified in this document.
  • 4.   Bookings are only deemed to have been made once they have been confirmed by PPSA.
  • 5.   If a course booking is cancelled by the applicant more than 1 week before the course commencement date only the deposit will be forfeited. In the case of cancellation by the student, if insufficient notice is given and/or your cancelled place on the course is not filled on a fee-paying basis, you forfeit the entire course fee. For this clause insufficient notice is 7 days or less prior to the training start date. The course fee cannot be refunded for any reason once the course has been started.
  • 6.   If, for any reason, PPSA is unable to offer the confirmed course, we will transfer your booking to another mutually acceptable date or refund the deposit and any balance paid. PPSA reserves the right to reschedule the timings and/or location of any course in full consultation with course participants. PPSA will not be responsible for any other costs.
  • 7.   No interest will be payable on any amounts refunded.
  • 8.   Prices in our brochure and website are inclusive of VAT where applicable. Prices may change from time to time, the price payable is that advertised at the time of booking.
  • 9.   Students should ensure that they are physically able to take part in the course. Any pre-existing medical conditions must be declared at the time of booking. Details of any medication being taken must be recorded on the booking form and the instructor must also be informed at the time of boarding/commencement of the course. Failure to comply with this clause will invalidate any claim against PPSA arising from any medical complaint not previously disclosed.
  • 10.   Students must always comply with reasonable instructions of PPSA staff throughout the course. The decision of any PPSA Instructor is final.
  • 11.   On completion of the course, your instructor will need to be satisfied that you have demonstrated the appropriate level of competence before an RYA certificate will be awarded. Attending a course does not automatically result in an RYA certificate being issued.
  • 12.   PPSA, its servants, agents, instructors and principal do not accept any responsibility for any loss damage or injury suffered by any persons and/or their property arising out of or during the course unless such loss or damage was caused by or resulted from negligence.  It is recommended that students take out their own travel insurance.
  • 13.   Any complaints must be made in writing/email within 28 days from the completion or cancellation of the course to the PPSA Chief Instructor. Complaints received after this date will be invalid. In the event of a complaint received by the RYA, they may need to contact you and any instructors involved to investigate the complaint for quality assurance of RYA Training. Any information requested is used solely for this purpose.  This does not affect your right to provide feedback on the forms provided by PPSA.
  • OWN BOAT TUITION
  • 14.   It is the responsibility of the owner of the vessel to inform their insurance company that they are receiving instruction from a professional instructor and wish the insurance to cover the Instructor, and his/her liabilities, for the duration of his/her time on board. It is a condition of this booking that the owner of the vessel is always in command of the vessel. By signing the declaration below, you accept to comply unconditionally with this clause.
  • LIMITATION
  • 15.   Any claim arising from or in connection with this Agreement to be brought by one party against the other shall be brought within six months of the completion date of the course or delivery, failing which such claims shall be time-barred.
  • SEVERANCE
  • 16.   The invalidity in whole or in part of any clause in this Agreement shall not affect the validity of the remainder of such clause or this Agreement.
  • LAW AND JURISDICTION
  • 17.   This agreement shall be governed by and construed in all respects in accordance with the Laws of England and Wales shall be subject to the exclusive jurisdiction of the Welsh Courts.
